- General Demurrage & Detention Information.
Import Demurrage and Detention
- Free time, demurrage, and detention terms apply to the country where the Empty unit is gated-in by the customer or at the location designated by the carrier.
- Demurrage & Detention combined | from discharge of Full unit at terminal/ depot to gate in Empty return of the unit at terminal/depot.
- Charges in USD per calendar day (including weekends and holidays).
- Maersk uses a Progressive method to calculate demurrage and detention charges after the free time expires. For customers with special agreements, exceeding the extended free time will incur demurrage and detention charges based on the relevant day count within our tiered tariff structure. This means that subsequent charges beyond the extended free time will not automatically be calculated using the first-tier rates. Discharge Date is considered the starting point for calculating demurrage and detention combined.
- Free Time.
- Intermodal Free Time: Free time conditions are the same for both Carrier and Merchant Haulage. The Free Time period begins on the discharge date of the full unit and ends upon the gate-in of the empty unit to the terminal or depot assigned by the carrier
- Hazardous cargo receives the same free time conditions as dry units. However, responsibility for the handling and storage of hazardous cargo at terminals and depots remains with the cargo owners.
- Non-Operating Reefe (NOR): DRY equipment (40DRY includes 8'6 & 9'6) free days and per diem conditions applies to NORs. NOR with Harzadous Cargo will be treat as DRY
- Equipment Types.
- Dry Equipment refers to 20-foot Dry, 40-foot Dry, 40-foot High-Cube, 45-foot Dry, and Reefer units (20'RF, 40'RF, and 40'RH). Special equipment includes Open Tops, Flat Racks, and Out-of-Gauge cargo. SOC Equipment refers to equipment owned by the merchant/shipper. COC refers to equipment owned by the carrier.
- Shipper-owned containers (SOC) are not subject to detention but are subject to storage and demurrage charges.
- Special Conditions.
- Spot conditions may differ from the conditions mentioned above. Maersk Spot (instant booking system) conditions are available in the downloadable document provided Here, which supersedes any separately agreed-upon terms. If you have any doubts, please check with the shipper or your local agents to confirm the booking/shipment modality you used. Link to downloadable document
- Demurrage and Detention charge applied to any given shipment depends to the PCD: Price Calculation Date (PCD). The following factors should be considered as guidance.
- PCD for non-FMC shipments – The date when the carrying vessel is scheduled to depart from the Port of Loading.
- PCD for FMC regulated trades – The date when Maersk Line takes possession of the last container listed on the transport document. This affects the Demurrage and Detention special free time. You will need to negotiate and mutually agree on the specifics before or on the Price Calculation Date.
- Other Important Information.

- Terminal storage charges may apply, nevertheless, those are charged directly by Terminal Operator.
- Terminal plug-in and electricity charges may apply; however, these charges are billed directly by the Terminal Operator.
- The Shipper assumes, prior to the shipowner, the contractual and legal duty to export/ship their cargo to a Consignee who has a genuine interest and the necessary conditions to acquire/receive the imported cargo. The Shipper is responsible for promoting the effective removal of the cargo at the destination and fulfilling all obligations associated with this act. If the cargo is abandoned at its destination or if the Consignee fails to remove it for any reason, the Shipper shall be jointly and severally liable, together with the Consignee, for all amounts, costs, expenses, damages, or losses incurred by the carrier as a result of this situation.
Invoicing: Customer must be aware that invoicing is split as followed:
- Liner Invoices
- Agency Invoices – Local charges (To be issued by local Maersk Agency Transporte & Logistica Paraguaya SRL.
- River freight: Due tax complexities Ocean freight and river freight were divided in 2 different fees. Every import shipment to Paraguay will have an additional freight charge that covers transshipment to final destination. This additional freight is subject to taxes that must be assumed by customer.
Payment condition for River Freight can be Prepaid or collect and must be declared with Shipping instructions.
Restrictions
All bills with destination Paraguay must show a consignee located in Paraguay, Non-compliance of above will require amendment of import manifest and river bills issued by barge operator at destination which will result in extra charges to be paid by customers related to Customs fines and/or penalties. This could also result in cargo auction.
Following information are not accepted in transport documents:
- BL only "TO ORDER"
- Foreign Consignees (including foreign banks)
- Local banks as consignee.
- Private persons – Sole proprietorship as consignee. Consignee must be a legal entity (RUC starting with 80XXXXXX-X)
Commodities
Used tyres: Used tyres (even recycled ones) are not accepted in Paraguay; no shipments with this type of cargo will be accepted. This is without exception.
Used vehicles: Paraguayan local authorities only allow to import vehicles manufactured within last 10 years.
The restriction about importing vehicles manufactured within the last 10 years has exceptions granted by our local Law
Exception related to this prohibition are:
- Used agricultural machinery,
- Used construction machinery,
- Used Tractor trucks (truck heads)
- with more than twenty tons of load capacity; of any origin, model or year of manufacture.
- Used classic sports vehicles of any origin.
- Consignee that has exception approval document from government: “Carta de inconstitucionalidad”
Firearms and weapons: The following commodities are prohibited
- Firearms, Pistols, Machine guns, Handguns, Rifles, Ammunition/Bullets thereof, and those parts
- Explosive substances
- Gunpowder, Dynamite
- Precursor Material for Chemical Weapon
Gas lighters IMO 2.1: NOT accepted for any import shipment to Paraguay.
Fireworks IMO 1.4: NOT accepted for any import shipment to Paraguay.
Explosives IMO 1.3: NOT accepted for any import shipment to Paraguay.
Radioactive Cargo IMO 7: NOT accepted for any import shipment to Paraguay.
Personal effects shipments
Due to complexity of business and cargo release, we have decided (with immediate effect) to NO longer accept personal effects in Paraguay and/or household goods shipments with final destination Paraguay.
All cargoes with personal effects/household goods identified with final destination Paraguay will be returned to origin with no exception.
Container types
45´foot containers: Are NOT accepted for any import shipment to Asuncion.
B/L Clause/Documentation
Cargo in transit to inland locations must be always arranged by account and risk of consignee and transit clause must be presented on B/L body. “In transit to…” clause is mandatory for all cases with inland to Paraguay
Cargo to destination Asuncion Villeta ANNP (PYANP):
PYANPTM: All import shipments into Paraguay where commodity has HS CODE/NCM 3808 (3808.XX.XXX) and/or state-owned, government-owned cargoes must discharge at Asuncion Villeta ANNP (PYANP): PYANPTM. Please make sure the booking has the correct transport plan whenever this HS code is involved.
If cargo is discharged in another port different than Asuncion Villeta ANNP (PYANP): PYANPTM due to force majeure, cargo is to be transported to correct terminal by merchant haulage. Customs clearance will not be allowed on other ports. This is without exception.
Documentation Requirements
Originals B/L must be surrendered by consignee for any cargo with final delivery in Paraguay to receive from Maersk’s Agent in Paraguay – Transporte & Logistica Paraguaya S.R.L. the River B/Ls and cargo release.
If one container is manifested in more than one B/L, all B/Ls for one (1) container must have one (1) same consignee.
Paraguay Customs will not release containers under one Bill of Lading unless the whole lot arrives in the same vessel.
Weight on the Bill of Lading must be shown in kilograms.
Guarantee letter must be presented in Asuncion to obtain cargo release. Letter must be signed in company’s letterhead, endorsed by general manager / director and Customs’ broker. Letter must also be certified by public notary.
Documentation: B/Ls with consignee “TO ORDER” or with foreign consignee are not allowed for Paraguay import, and neither B/Ls with data from foreign banks not located in Paraguay. Import cargoes must have a local customer as consignee.
Paraguayan Customs will reject cargoes with generic description. B/Ls must count with an extensive description of cargo and the correct NCM.
All bills with destination Paraguay must show a consignee located in Paraguay,
Mandatory information to include on TPDOC:
- RUC (Similar to VAT ID) must be added on consignee doc address.
- Paraguayan consignee
- HS CODE/NCM (shown in cargo description)
When the commodity is vehicles VIN ID/CHASSIS number must be added. Non-compliance of this will result in customs fines and/or penalties. This could also result in cargo auction.
SEALS numbers are mandatory to be shown in each Tpdoc/manifest. Bls reading no seals or ML-None are not accepted.
NCM/HS code must be added to cargo description. This is without exception as this is required by customs authorities Cargo in transit to inland locations must be always arranged by account and risk of consignee and transit clause must be presented on B/L body. “In transit to…” clause is mandatory for all cases with inland to Paraguay
Import of new/used Vehicles: On details of B/Ls, shipper must specify Chassis Number, Brand and Model. Non compliance of this will result in customs fines and/or penalties. This could also result in cargo auction.
Customs requirements
As it is stated in AFIP’s General Resolution 2744 and 2879 from Argentina’s Customs office, NCM must be declared in transshipment manifest for all shipments with transshipment taking place in Argentina.
